The Path to Portuguese Citizenship: Current Status and Proposed Changes

Portuguese citizenship represents the ultimate objective formost Golden Visa participants, offering unrestricted access to live, work, andtravel throughout the European Union's twenty-seven member states, along withvisa-free or visa-on-arrival access to approximately 190 countries worldwide.

Current Citizenship Requirements

Under the existing nationality law, foreign residents canapply for portuguese citizenship after maintaining legal residency for fiveyears, provided they meet several additional criteria. Applicants mustdemonstrate basic portuguese language proficiency at the A2 level on the CommonEuropean Framework of Reference for Languages (CEFR), typically by passing theCIPLE (Certificado Inicial de Português Língua Estrangeira) examination orcompleting a 150-hour Portuguese Language and Culture (PLA) course.

Applicants must also prove an effective connection to theportuguese community, maintain a clean criminal record both in Portugal andtheir country of residence, and demonstrate sufficient ties to Portuguesesociety. Importantly, recent administrative clarifications confirmed that thefive-year residency period begins counting from the date the Golden Visaapplication is submitted and the state fee is paid, rather than from the datethe residence permit is ultimately issued. This interpretation helps compensatefor administrative processing delays.

Proposed Nationality Law Amendments and ConstitutionalReview

In June 2025, the portuguese government proposed sweepingamendments to the nationality law that would fundamentally alter the timelineand requirements for citizenship acquisition. The most significant proposedchange would extend the minimum residency requirement for citizenship from fiveto ten years for most applicants, or seven years for citizens ofPortuguese-speaking countries (CPLP members) and European Union nationals.

The Portuguese Parliament approved these amendments onOctober 28, 2025, but their implementation has been blocked by constitutionalchallenges. In November 2025, the Socialist Party (PS) bypassed the Presidentand requested a preventive constitutional review by Portugal's ConstitutionalCourt. On December 15, 2025, the Constitutional Court declared four provisionsof the proposed amendments unconstitutional, preventing the law from enteringinto force as drafted.

The Court's decision upheld the proposed extension of thecitizenship timeline in principle but left critical questions unresolvedregarding how residence time should be calculated and whether any transitionalprotections should apply to current residence permit holders who have not yetapplied for citizenship. The amendments must now return to Parliament forrevision, and no timeline exists for when modified legislation might bereintroduced, voted upon, and ultimately implemented.

This constitutional uncertainty creates both risk andopportunity for prospective Golden Visa applicants. Those who obtain residencepermits under the current five-year framework may benefit from grandfatheringprovisions if they apply before any revised amendments take effect. However,the political momentum clearly favors stricter requirements, making earlyapplication strategically advantageous.

Citizenship Through Other Pathways

Beyond naturalization through residence, Portugal offerscitizenship by descent for individuals with Portuguese parents or grandparents,though grandchildren must demonstrate an effective connection to Portugal andPortuguese language proficiency. Portugal also grants citizenship to spouses ofPortuguese citizens after three years of marriage, without requiring residencein Portugal, provided the spouse proves an effective connection to Portuguesesociety.

Notably, Portugal's special citizenship pathway forSephardic Jews descended from communities expelled during the PortugueseInquisition has been terminated, with the government extending the applicationdeadline only through December 31, 2025 for those applying under previouscriteria.
